Terms of Service

These Terms and Conditions govern the relationship between the Provider and users of the Pixendo service ("User"). Effective from 2026-07-19.

1. Provider

The provider of the Pixendo service is Matěj Čičák, company registration number (IČO): 06740707, registered office at Borkovany 140, 691 75 Borkovany, Česká republika, a self-employed individual trading under the Czech Trade Licensing Act and entered in the Trade Licence Register ("Provider"). Contact: info@pixendo.cz or WhatsApp. The Provider is not registered for VAT.

2. The service

Pixendo lets Users upload a photograph, use artificial intelligence tools to turn it into an image in a chosen art style ("Design"), and order it printed on a physical product or delivered digitally.

Creating an account and generating Designs is free. The Design preview carries a watermark, which is removed only once a product has been paid for. The Provider does not guarantee any particular artistic outcome — the appearance of a Design depends on the source photograph and the chosen style.

3. Registration and user account

Generating designs and placing orders requires registration and logging in. The User is responsible for the accuracy of their details and for keeping their account credentials secure. The account is for personal use; sharing access with third parties is at the User's own risk.

The User may delete their account at any time from their profile, or by sending a request to info@pixendo.cz or WhatsApp. Deleting the account also deletes any stored Designs; data required for accounting purposes and for handling orders already placed is retained for the legally required period.

4. Ordering, payment and delivery

An order is created and becomes binding once completed and confirmed in the system. Before completing an order, the User approves a binding preview of the product; the approved preview governs production.

Payment is made online via the Stripe payment gateway (Visa and Mastercard cards, Google Pay, Apple Pay). The Provider does not process or store payment details. The product goes into production once payment has been received.

Physical products are made to order and delivered within the European Union. Production and delivery together usually take 3–11 working days from payment. These timeframes are estimates, not a binding delivery deadline; a specific estimate is shown at checkout based on the delivery address and chosen product.

Digital downloads are made available immediately after payment, both in the user account and via a link sent by email.

5. Print partner

Production and delivery of physical products is carried out on the Provider's behalf by the print partner Gelato, through its network of contracted print shops across the European Union. An order is typically produced at the print shop closest to the User's delivery address. Only the data necessary for delivery (name, delivery address, contact details, print file) is shared with the print partner for this purpose. The Provider always remains the User's contracting party and is responsible for fulfilling orders and handling complaints.

6. Price

Prices are shown on the website for each product and on the Pricing and shipping page. The price shown in the basket before an order is completed is final and includes all processing fees; the delivery cost is shown separately unless stated as included in the product price. The Provider is not registered for VAT, so no VAT is added to the price.

Discount codes can only be applied in the basket before an order is completed, cannot be combined unless expressly stated otherwise, and cannot be applied retroactively.

7. Withdrawal from the contract (notice under Section 1820 of the Civil Code)

Goods are made to order based on the User's photograph and specifications. Under Section 1837(d) of the Czech Civil Code (and Article 16(c) of Directive 2011/83/EU), a consumer therefore cannot withdraw from a contract for goods manufactured to their specifications or personalised for them.

For digital content supplied electronically, the User expressly agrees to delivery before the 14-day withdrawal period expires and acknowledges that this ends the right of withdrawal (Section 1837(l) of the Civil Code). The User acknowledges this notice before completing an order, when giving binding approval of the product preview.

The inability to withdraw from the contract does not affect rights arising from defective performance — a defective, damaged or non-conforming product can always be reported as a complaint under the Complaints policy.

8. Complaints (rights arising from defective performance)

The User has the right to report defective performance — in particular a damaged or poor-quality print, the wrong format, a different product than ordered, or an incomplete delivery. A complaint can be submitted by email to info@pixendo.cz or WhatsApp with the order number, a description of the defect and a photograph. The Provider will decide on the complaint without undue delay and resolve it within 30 days of it being raised at the latest.

A characteristic of the AI-generated design that the User approved in the binding preview before ordering is not a defect; however, the printed product must match the approved preview. The detailed procedure is set out in the Complaints policy.

9. Responsibility for uploaded content

The User is fully responsible for the content of uploaded photographs and confirms that they hold the necessary rights to them, including the consent of any people shown. Uploading content that is illegal, offensive, violent, sexually explicit, depicts minors in an inappropriate context, or is protected by third-party rights without consent, is prohibited.

The Provider may refuse to process or produce such a request and, in the event of repeated breaches, close the account. Suspected rights violations (for example, a photograph uploaded without the consent of the person shown) can be reported to info@pixendo.cz or WhatsApp; the Provider will remove such content without undue delay after review.

10. Rights to Designs

Once paid for, the User has the right to use their Design for personal purposes, including printing, sharing and use as a profile picture. Commercial use (selling prints, merchandising, use in advertising) is possible only by prior written agreement, arranged via info@pixendo.cz or WhatsApp.

The Provider may display generated Designs as examples in the service's gallery only where the User has given consent to this; consent may be withdrawn at any time by email.

11. Service availability and limitation of liability

The service is provided "as is". The Provider works to keep it continuously available but does not guarantee uninterrupted operation — running the service also depends on third-party services (hosting, computing capacity for generation, the payment gateway, the print partner). The Provider is not liable for damage caused by temporary unavailability of the service.

If an order cannot be produced for technical reasons, the Provider will inform the User and refund the amount paid in full.

12. Out-of-court dispute resolution

The Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Prague 1, www.coi.cz, is the competent body for out-of-court resolution of consumer disputes. Consumers may also use the Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

13. Personal data protection and cookies

Rules on the processing of personal data are set out in the Privacy Policy; the use of cookies and similar technologies is set out in the Cookie Policy.

14. Final provisions

This relationship is governed by the law of the Czech Republic; this does not affect any rights the consumer has under the law of the country of their habitual residence. The Provider reserves the right to change these Terms and Conditions; for orders already completed, the version in effect at the time the order was placed always applies. The current version is always available on this page.
